The Trusts Act 2019: Implications for trustees of charitable trusts and NFPs

Overview

Many New Zealanders are involved with trusts in some way. As trustees, beneficiaries of family trusts or volunteers on charitable trusts, it is important to be aware of the effects of the new Act.

The Trusts Act 2019 will replace the Trustee Act 1956 and applies to all existing and future trusts in New Zealand.  Jessica and Stephanie will outline compliance requirements, trustee obligations and issues for trustees to be aware of to prepare for the changes.

This session is designed for trustees of charitable trusts and not-for-profits. The event will also be available via live webcast.

Professor Jessica Palmer

Professor Jessica Palmer is the Dean of the Otago Faculty of Law and a member of the senior leadership group of the University’s Division of Humanities. She also teaches and researches in contract, trusts and commercial law. She is regularly involved in providing continuing legal education for lawyers and judges across New Zealand. Before joining the Otago Law Faculty in 2005, she served as a Judges’ Clerk in the High Court in Auckland and worked in a national commercial law firm.  

Jessica’s governance experience has been primarily in the not-for-profit sector in large multi-million dollar operations. She is currently a member of the Board of Presbyterian Support Otago, chair of Laidlaw College, deputy chair of Knox College and Salmond College Incorporated, and trustee of a faith-based philanthropic organisation based in Auckland.

Jessica is a Chartered Member of the Institute of Directors and winner of the 2020 Otago Southland branch Emerging Director Award.

Stephanie Pettigrew

Stephanie is a partner at Marks & Worth Lawyers where she leads their personal client services team and specialises in trusts, relationship property and elder law. She has been involved in governance roles in the charitable and social services/not for profit sector for over 10 years. She is a trustee of Presbyterian Support Otago, where she is the deputy chairperson.

Stephanie has recently completed a director internship with the board of Port Otago Limited. She has previously been a trustee and chairperson of the Able Charitable Trust and SF Otago, both charities which support families and individuals affected by mental illness. 

Stephanie is a member of the Institute of Directors and was runner-up for the 2020 Otago Southland branch Emerging Director Award.
