Submission on addressing temporary migrant worker exploitation

We support the goal and objectives of the Temporary Migrant Exploitation Review being carried out by the Ministry of Business, Innovation and Employment (MBIE). The review is aimed at reducing the exploitation of temporary migrant workers.   

In a consultation document, MBIE is considering reforms in subcontracting, franchising, and labour hire business models.

One option MBIE is considering is broadening the range of parties who may be held liable if an employer breaches employment standards. This would include persons that have a significant level of control or influence over the employer.

The IoD’s submission mainly focuses on this option. We highlight some issues and concerns and encourage MBIE to undertake further analysis and learn from experience overseas.
