Overview

Insolvency statistics have been at record lows for the past three years and most businesses have survived the bumps in the road recently with support from the Government, banks and IRD (not to mention increased demand from customers for goods and services).  But, in some cases, the virtual economic can that was kicked down the road is starting to be seen again.  Interest rates, inflation, supply chain and labour shortages are building pressure on businesses. Confidence is also under pressure as well as house prices. How should directors respond to these changes and what duties do you have to shareholders and creditors when companies get into cash flow difficulty - or enter the twilight zone, where survival is uncertain?  

In his presentation, turnaround and insolvency expert John Fisk will traverse a range of practical solutions from his experience working with directors and the impact of recent legal decisions. He will address working capital issues, seeking advice, communication with stakeholders and the practical implications for directors to consider when they enter the 'twilight' zone of insolvency and potentially face personal liability.

John Fisk

John Fisk is on the board, and is the immediate past-Chair, of the Restructuring Insolvency and Turnaround Association of New Zealand (RITANZ).  RITANZ is a member of Insol International, a worldwide federation of national associations of accountants and lawyers who specialise in turnaround and insolvency.  John was appointed by the government to be a member of the Corporate Insolvency Working Group in 2015, making a range of recommendations to improve our insolvency laws and leading to the regulation of Insolvency Practitioners. In 2020 he was also instrumental in assisting MBIE with new legislation to assist directors and businesses facing viability issues because of Covid-19.  He is a partner at PwC in Auckland and provides advice to directors as well as managing a wide range of formal insolvency matters, including the recent Voluntary Administration of Ruapehu Alpine Lifts Limited.
