Overview

Anderson Lloyd's John Farrow and James Cowan will discuss the sentencing decision in New Zealand's first Health and Safety prosecution of a director for failing to comply with due diligence duties. They will also discuss topical health and safety issues including COVID-19 vaccinations considerations in the workplace.

Speakers

James Cowan

James is an Associate in Anderson Lloyd’s Employment and Litigation team.  He regularly advises on compliance with Health and Safety legislation; represents PCBUs during Serious Incident Investigations and provides representation in Court, when required.  He has advised on multiple successful Applications for Enforceable Undertakings (as an alternative to prosecution), including New Zealand's first ever Court-ordered enforceable undertaking under the Health and Safety at Work Act 2015.  He is a Dunedin Local (save for a brief six-year stint working in Auckland) and studied at the University of Otago, completing a Bachelor of Laws in 2011.   

 John Farrow

John joined Anderson Lloyd in November 2017 with over 25 years’ experience as a lawyer and, of those, more than 20 as a partner.  After studying at the University of Otago, he graduated with a Bachelor of Laws and Bachelor of Arts (majoring in English).  John is a Partner co-leading Anderson Lloyd's national Employment and Health and Safety Team. His primary areas of practice are employment and health and safety. His expertise covers the full range of employment matters, including those that involve criminal and civil aspects. He also has extensive stand-alone experience in criminal and family court jurisdictions. He has represented employees, senior executives, small to medium sized businesses, councils, local authorities, and corporates.  John is a LEADR-accredited Mediator and Member of the Institute of Directors. He is named in the 'Best Lawyers in New Zealand' publication, Labour and Employment Law category, and as a 'next generation partner' in the Legal 500.
